Associated General Contractors of California (“AGC” or “We”) respects your privacy and is committed to protecting it through our compliance with this policy.  This policy describes the types of information we may collect from you or that you may provide when you visit the website agcofcabeta.wpengine.com (“Website”), and our practices for collecting, using, storing, maintaining, protecting, and disclosing that information.  This policy applies to information we collect on this Website, through third-party payment services for purchase from or through the Website, or in email and other electronic messages between you and this Website.  It does not apply to information collected by us offline or through any other means, including on any other website operated by AGC or any third party, or by any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Website.  Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it.  If you do not agree with our policies and practices, your choice is to not use our Website.  By accessing or using this Website or purchasing items from or through this Website, you agree to this privacy policy.  This policy may change from time to time.  Your continued use of this Website after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

1. Information Collection Practices

a. Types of Information Collected

We collect and store certain information from and about users of our Website, including information by which you may be personally identified, such as name, mailing address, e-mail address, telephone number, social security number or any other identifier by which you may be contacted online or offline, as well as financial information related to purchases from or through the Website, such as credit card number, debit card number, security code, expiration date or (“personal and financial information”).  This information is collected directly from you when you provide it to us (e.g., by paying for purchases), automatically as you navigate through the site (e.g., usage details, IP addresses, domain name, type of browser, equipment being used), or from third parties (e.g., our business partners).  We use “cookies” only to store user preferences and to record session information (e.g., user password, items added to a shopping cart).

As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information, including browsing actions and patterns, and details of your visit to our Website, including traffic data, logs communication data and the resources that you access and use on the Website.  The information we may collect automatically is only statistical data and does not include personal and financial information.  It helps us to improve our Website and to deliver a better service to all customers.

b. Uses of Information Collected

AGC’s primary objective in collecting user information is to provide the best member and customer service possible.  AGC collects and stores personal and financial information in order to assist customers in the check-out process in the future.  We use information that we collect about you or that you provide to us, including any personal and/or financial information, to provide you with this information or services, to fulfill any other purpose for which you provide it, to provide you with notices about your account, to carry out our obligations and enforce our rights arising from any contracts entered into between you and us (e.g., billing and collection) and in any other way we may describe when you provide the information or for any other purpose with your consent.

c. Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.  We may disclose personal information that we collect or you provide as described in this privacy policy with AGC affiliates and related third parties, for the purpose of providing products, services, and resources offered by AGC and for any other purpose disclosed by us when you provide the information.  AGC occasionally shares some collected non-financial information with member and nonmember individuals and entities.  AGC generally does not sell or trade collected information to third parties specifically for commercial use.  Third parties may collect your information when you use our Website or online services.  We do not control third parties’ collection or use of your information to serve interest-based advertising.  However, these third parties may provide you with ways to choose not to have your information collected or used in this way.  You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

d. Do Not Track Signals

Some browsers have a “do not track” feature that lets you tell websites that you do not want to have your online activities tracked.  At this time, we do not track our customers over time and across third-party websites to provide targeted advertising and therefore AGC does not respond to Do Not Track (DNT) signals.  The information we may collect automatically is only statistical data and does not include personal and financial information.  It helps us to improve our Website and to deliver a better service to all customers.  However, you do have the option to opt-out of interest-based advertising (see above) or opt-out of the selling of your personal information at any time (see below).

2. Accessing and Correcting Your Information

You can review and change your personal information by logging into the Website and visiting your personal account profile page.  You may also send us an email at member_services@agc-ca.org to request access to, correct, or delete any personal information that you have provided to us.  We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

3. Children Under the Age of 16

4. California Privacy Rights

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information. 5. Data Security

This Website and the servers that store collected information have industry–standard security measures in place to protect against the loss, misuse, and alteration of the information under AGC’s control.  Please note, however, that no security system is 100% secure.  Authentic Website pages requesting credit card information will be secure web pages, and sensitive data will be encrypted for transmission.  Although we do our best to protect your personal and financial information, we cannot guarantee the security of your personal information transmitted to our Website.  Any transmission of personal information is at your own risk.  We are not responsible for circumvention of any privacy settings or security measures contained on the Website.  Absent user consent, AGC does not knowingly share credit card numbers or information, social security numbers or other related financial information with third parties except to the extent necessary for, and incidental to, the purposes for which the user supplied the information.

The safety and security of your information also depends on you.  Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential.  We ask you not to share your password with anyone.

6. Personal Information Sales Opt-Out and Opt-In Rights

If you are 16 years of age or older, you have the right to direct us to not sell your personal information at any time (the “right to opt-out”).  We do not allow purchases by children under the age of 16, and therefore do not collect related personal or financial information from children under the age of 16.  Consumers who opt-in to personal information sales may opt-out of future sales at any time.

To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by sending an email to member_services@agc-ca.org.  Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales.  However, you may change your mind and opt back in to personal information sales at any time by sending an email to member_services@agc-ca.org.  You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

7. Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page.  We reserve the right, at any time and without notice, to add to, change, update, or modify this privacy policy simply by posting such change, update, or modification on the Website and without any other notice to you.  Any such change, update, or modification will be effective immediately upon posting on the Website.  The date the privacy policy was last revised is identified at the top of the page.  You are responsible for periodically visiting our Website and this privacy policy to check for any changes.
